Copyright Policy and DMCA Notice-and-Takedown Procedure

1. Our policy

IKU LOBI OCHA ("we", "the Platform"), operated by ESENCIA ESPIRITUAL LLC, respects the intellectual property rights of others and expects its users to do the same. Users are responsible for the content they upload, generate, publish or share through the Platform (videos, images, audio, music, stickers, overlays and similar material) and must own or have all necessary rights and licenses for it. We respond to valid notices of alleged copyright infringement in accordance with the U.S. Digital Millennium Copyright Act (17 U.S.C. § 512, the "DMCA") and, where applicable, other laws such as the EU Digital Services Act.

2. How to report alleged infringement (DMCA notice)

If you believe that material hosted on the Platform infringes your copyright, send a written notice to our designated copyright agent (section 3) that includes all of the following:

• A physical or electronic signature of the copyright owner or of a person authorized to act on the owner's behalf.
• Identification of the copyrighted work you claim has been infringed (or a representative list if several works are covered by one notice).
• Identification of the material you claim is infringing and that you want removed or disabled, with enough information for us to locate it (for example, the exact URL or link on the Platform).
• Your contact information: name, postal address, telephone number and e-mail address.
• A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent or the law.
• A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or are authorized to act on the owner's behalf.

Incomplete notices may not be actionable. Please note that under 17 U.S.C. § 512(f) anyone who knowingly materially misrepresents that material is infringing, or that it was removed by mistake or misidentification, may be liable for damages, including costs and attorneys' fees.

4. What we do when we receive a valid notice

Upon receiving a complete and valid notice we will act expeditiously to remove or disable access to the material identified, notify the user who uploaded it (including a copy of the notice), and take reasonable steps to keep a record of the notice. If the material is hosted by third-party providers on our behalf, we will forward the request to them where necessary.

5. Counter-notice

If you believe the material was removed or disabled by mistake or misidentification, or that you have the right to use it, you may send a counter-notice to the designated agent above containing: (a) your physical or electronic signature; (b) identification of the material removed and where it appeared before removal; (c) a statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification; and (d) your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal court for the district where your address is located (or, if outside the United States, of any judicial district in which we may be found) and that you will accept service of process from the person who submitted the original notice.

If we receive a valid counter-notice we will send a copy to the complainant. Unless the complainant notifies us within 10 business days that it has filed a court action seeking an order against the alleged infringer, we may restore the material between 10 and 14 business days after receiving the counter-notice.

6. Repeat infringers

In appropriate circumstances we will suspend or terminate the accounts of users who are repeat infringers. Each valid notice against a user is recorded; a user who accumulates repeated valid notices may lose access to the Platform without refund, in accordance with our Terms and Conditions.

7. Other illegal content

For reports of other illegal content or notices under the EU Digital Services Act, write to the same e-mail address, indicating the exact location (URL) of the content, the reasons why you consider it illegal, and your name and e-mail address. We will review the report and reply as soon as reasonably possible.

IKU LOBI OCHA, operada por ESENCIA ESPIRITUAL LLC, respeta los derechos de propiedad intelectual de terceros y exige lo mismo a sus usuarios. Cada usuario es responsable del contenido que sube, genera o publica en la Plataforma y debe contar con todos los derechos y licencias necesarios. Atendemos los avisos válidos de presunta infracción de derechos de autor conforme a la ley estadounidense DMCA (17 U.S.C. § 512) y, cuando corresponda, a otras normas como el Reglamento de Servicios Digitales de la UE.

Cómo avisar de una infracción. Si crees que un contenido alojado en la Plataforma infringe tus derechos de autor, envía un aviso por escrito al agente designado (más abajo) que incluya todo lo siguiente: (1) tu firma física o electrónica, o la de quien actúe en nombre del titular; (2) la identificación de la obra protegida que consideras infringida; (3) la identificación del contenido que consideras infractor y su ubicación exacta (por ejemplo, el enlace o URL en la Plataforma); (4) tus datos de contacto: nombre, dirección postal, teléfono y correo electrónico; (5) una declaración de buena fe de que el uso del contenido no está autorizado por el titular, su representante ni la ley; y (6) una declaración, bajo pena de perjurio, de que la información del aviso es exacta y de que eres el titular o estás autorizado a actuar en su nombre. Quien declare falsamente que un contenido es infractor puede ser responsable de los daños causados (17 U.S.C. § 512(f)).

Qué hacemos. Ante un aviso completo y válido retiramos o bloqueamos el acceso al contenido a la mayor brevedad, avisamos al usuario que lo subió (con copia del aviso) y guardamos registro del aviso.

Contraaviso. Si crees que el contenido se retiró por error o tienes derecho a usarlo, puedes enviar un contraaviso al agente con: tu firma; la identificación del contenido retirado y dónde estaba; una declaración bajo pena de perjurio de que crees de buena fe que se retiró por error o identificación equivocada; y tu nombre, dirección y teléfono, junto con tu consentimiento a la jurisdicción del tribunal federal que corresponda y a recibir notificaciones de quien presentó el aviso original. Enviaremos copia al denunciante y, salvo que este nos comunique en 10 días hábiles que ha iniciado una acción judicial, podremos restituir el contenido entre 10 y 14 días hábiles después de recibir el contraaviso.

Infractores reincidentes. En los casos que corresponda suspenderemos o cerraremos las cuentas de usuarios que reincidan en infracciones, sin derecho a reembolso, conforme a nuestros Términos y Condiciones.

Otros contenidos ilegales. Para denunciar otros contenidos ilegales o avisos del Reglamento de Servicios Digitales, escribe al mismo correo indicando la ubicación exacta (URL), los motivos por los que lo consideras ilegal y tu nombre y correo.
